1. These terms and conditions (including our Data Protection and Privacy Policy) govern the collection and use of points and set out the terms of contract between HMV UK Limited (‘HMV’, ‘us’ or ‘we’) and you the customer relating to the Rewards Club. You can register with the Rewards Club by buying a purehmv card ("Card") in participating stores and online at www.hmv.com/pure and can earn points on hmv purchases (exclusions apply see point 2 in section ‘How to collect and spend points). Points can only be spent on the arena at www.hmv.com/arena against a variety of rewards (‘Rewards’). If you buy or in limited circumstances in store to register with us or use your Card you accept these terms and conditions. We may refuse an application to join the Rewards Club for any good reason.
2. To register for the Rewards Club you will need to either (a) complete an application form in a participating store; or (b) go on line at www.hmv.com/pure to register for the Rewards Club. As part of registering for the Rewards Club, you will also register as a customer of www.hmv.com. In each case a Rewards Account will be created in your name to record points to earned by you. You must be 16 years of age or over, resident in the UK and register an email address, to join the Rewards Club. Membership of the Rewards Club is limited to a maximum of one account per member. If you do not register your card you cannot spend your points.
3. Your Card is issued by and remains the property of HMV UK Limited. You must return your Card to us on request or destroy it if we so request. You are responsible for the security of your Card and for any transactions and/or redemption of points made using your Card. If you lose your Card or think an unauthorised person has become aware of any security code, password or Card number you should promptly contact the member helpline, which appears below.
4. To join the Rewards Club you will need to pay a £3 fee. HMV reserves the right to waive or alter the amount of this joining fee. In addition, HMV reserves the right to (a) alter the products included or excluded from the Rewards Club; (b) the products on which points may be earned; (c) to alter the amount of spend required to earn points; (d) alter the number of points per pence/pound of spend; (e) to alter the number of points required to get any item on the arena; and (f) to change the number of participating stores at any time.
5. Your Card can be used to earn points at HMV Stores (except stores in the Republic of Ireland) and online at www.hmv.com. Points will expire if unused for a period of 2 years, however your Rewards Account and Card will remain valid, subject to paragraphs 11 and 12 below.
6. You can get regular updates on the number of points you have earned or redeemed by logging on to My Account at www.hmv.com and accessing your Rewards Account.
7. Your Card is for your personal use. It cannot be transferred and points cannot be earned or used on your account by third parties
8. Your Card cannot be used as a credit card or a guarantee card.
9. Your name, date of birth, address and email address, must be provided for a Card to be registered. If you do not register your Card you will not be able to redeem your points.
10. The Rewards Club is only for consumer use. The Card cannot be used for any transaction where the beneficiary is a business entity or for any other commercial purposes. Any points earned on transactions that are not in accordance with any of the above, or which are completed in order to make a financial gain, will be deemed to be in breach of these terms.
11. If you breach these terms, or if HMV reasonably believes that you have breached these terms and/or abused the Rewards Club, your Card may be terminated, any points earned but not used may be cancelled and your Rewards Account closed without prior notice. HMV reserves the right to take any action deemed necessary where a Cardholder is found to have abused the Rewards Club.
12. HMV reserves the right to (i) stop issuing Cards at any time; (ii) on notice to alter or amend the terms and conditions of operation of the Card and/or the Rewards Club; and/or (iii) on notice, withdraw or cancel the Cards and/or the points (including the redemption and issue of such) and/or (iv) terminate the Rewards Club. A Cardholder may terminate his/her Card and/or Rewards Account at any time.
13. Our Data Protection and Privacy Policy (which appears in brief below and in full in the arena on www.hmv.com/pure) sets out the information that we will collect about you, how we use the information and whom it may be shared with.
14. HMV operates a complaints handling procedure, which is used to try to resolve disputes when they first arise. If you have a complaint with the Rewards Scheme, please contact the purehmv Customer Service department at the following address: HMV UK Ltd, Princess House, 50 Eastcastle Street, London, W1W 8EA. Any complaints will be investigated thoroughly by the Customer Service department, and you will be notified of the outcome of this investigation.
15. We will notify Cardholders of any changes to these terms by posting any changes on www.hmv.com/arena.
16. The Rewards Club is operated and promoted by HMV UK Limited, Film House, 142 Wardour Street, London W1F 8LN, and subject to the laws of England.
1. To collect points for a transaction in a participating store, you must present your Card at the till at the time of purchase or within 30 days of the date of purchase. In the case of the latter, proof of purchase, using a till receipt, will be required for the points to be credited via your Rewards Account online at ww.hmv.com. To collect points for a transaction online, the unique number on your Card must be input at the time of registration and points will be earned automatically on each subsequent purchase made via your account online at www.hmv.com. You cannot claim points on purchases made before you joined the Rewards Club.
2. Points cannot be earned from the purchase of gift vouchers, gift cards, itunes gift cards, mobile etop-up cards, downloads, tickets purchased online or warranties.
3. Points are awarded at a rate of 1 point for every 1p spent. We reserve the right to vary the rates at any time at our discretion and on reasonable notice to you and to offer bonus points on certain products as selected by us from time to time and at our sole discretion.

5. Points will usually be added to your Rewards Account instantly, except in circumstances of system failure when it is expected that points will be loaded within 72 hours. In most circumstances any bonus points earned will be added to your Rewards account 72 hours after the date the goods are purchased. Points cannot be used until added to your Rewards Account. When a number of items are ordered online and are despatched at different dates, points will be added to your Rewards Account when the last item has been despatched to you.
6. You can spend your points on the arena, which can be accessed via My Account on www.hmv.com or via www.hmv.com/arena. No redemptions can be made in store except in limited circumstances. We reserve the right to amend the time the reward is made available to members. The Rewards will change from time to time, will only be available for a limited period of time and are subject to availability. Some Rewards may only be available to persons who are 18 or 21 years and over, and other conditions may apply to Rewards from time to time. Details of each Reward and any special conditions that apply thereto can be found on the arena. hmv cannot be held responsible if the event is cancelled due to unforeseen circumstances which are beyond their control. If for any reason the event cannot run as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of the event, hmv is entitled, in its sole discretion to inform the member as soon as possible and offer a full refund of points if applicable to the individual case. In exceptional circumstances hmv reserve the right to withdraw rewards once an email order confirmation has been sent due to, but limited to, site technical issues, discontinued ownership of a MAMA (Mean Fiddler) venue, cancellation of an event due to illness or bereavement, security issues and extreme weather aswell as member accounts under investigation for possible mis-use of the card or abuse of the scheme relating to commercial or unusual activity.
7. Rewards can only be earned by the use of points. No cash can be used for either full or partial payment for Rewards
8. All Rewards that are sent by post will be sent to the latest shipping address we have for you. It is important that you keep your Rewards Account details up to date. It may be necessary for us to contact you to arrange a timed delivery or to confirm your details. In these instances, if no response is received within 30 days from the date the order is placed, then HMV reserve the right to cancel the order and refund your points.
9. Points and Rewards have no cash redemption value and cannot be exchanged, sold or transferred. Rewards must not be resold. Resale of Rewards will be treated as an abuse of the Rewards Club with the consequences set out in paragraph 11 of "The Rewards Club" section above.
10. HMV will reverse the associated points earned if a transaction on which points are earned is cancelled or reversed or when a product is returned (in accordance with the HMV Returns Policy). For in store returns, you must present your Card to sales staff so that the points awarded can be debited from the Card for the product being returned. It is not possible to reverse points which have been used and the Reward has been sent to you. HMV reserves the right to terminate a member’s Card where it reasonably believes this process has been abused.

2. On signing up to the Rewards Club and giving us your personal details, you agree that your details will be used to send you information and updates about the Card/Rewards Club. We may also contact you for research purposes relating to the Rewards Club and send you details of products and services offered in-store and online (including special offers) unless you subsequently notify us otherwise.
3. We will also use your details from the application form and information on what you buy to help us manage the Rewards Club more effectively. We may share aggregated data with third parties in order to develop and enhance the Rewards Club. This is statistical data which will not include information that could identify any individual.
4. We will share your information with HMV Group companies (including HMV Guernsey Limited) and service providers to the Rewards Club and partner companies who may use your details to help us manage and administer the Rewards Club. With your consent, we may also share your details with third parties who may contact you with information and offers about their products and services.
5. It is important that your contact details are kept up to date in order that we can operate the Rewards Club effectively. Please keep your details up to date via your Rewards Account. You can also update your details at any time by calling the member helpline via the telephone number, which appears below.
1. If your Card is lost, stolen or, for whatever reason, not working, you should contact the member helpline by telephoning the number below. Calls are charged per minute at your service provider’s local rate. We cannot be held liable for lost, stolen or damaged Cards or any points accrued on or redeemed from your Rewards Account without your knowledge. We reserve the right not to issue a replacement Card. 2. The Rewards Scheme cannot be used in conjunction with any other discount, including student discount. 3. If any of these terms is held to be invalid in whole or in part, that part shall be deleted and the validity of the remaining terms shall not be affected. 4.
